Unlike Medicare and Medicaid, COBRA is not a federal insurance program.

  • But you might need to take the lead when the qualifying event is not one that directly pertains to the employee in question. the employer, for example, is less likely to be aware of a divorce or the loss of a child’s dependent status.
  • Under federal law, you have at most 60 days to provide notice of qualifying event, beginning with the date on which the event that termination of coverage occurred.

Review your COBRA election notice.

Within 14 days of you notifying your insurance company that you have experienced a qualifying event, it must provide you with a COBRA election notice.
